Existing hazardous waste sites or areas of suspected contamination make many contracts risky. Not infrequently, buyer and seller are only able to agree contractually (e.g., with warranty exclusion clauses) by substantially reducing the purchase price. An agreement which is not without problems since the buyer's side can claim a deficiency because the facts have not been sufficiently clarified (e.g., with random soil testing). In addition, both parties cannot make a contractual agreement as to which is legally responsible.

When forced administration of property is used as a supplemental or advance measure to successfully permit later foreclosure, the forced property administration manager may have cleanup measures performed after acquisition of the property. This unquestionably increases the value of the site.
